Imagica — Terms of Service

1. About Imagica & Service Availability

Imagica is an AI-powered creative platform that allows users to create, edit, transform, and enhance images using artificial intelligence. At this time, Imagica is provided to users free of charge.

Usage Limits: To maintain availability and stability for all users, we may impose reasonable usage limits, daily generation limits, rate limits, or concurrency restrictions. Free access does not guarantee unlimited or uninterrupted use. We reserve the right to restrict access where necessary to prevent abuse, excessive automated usage, security threats, or unreasonable consumption of resources.

Modifications: We may add, modify, improve, suspend, or discontinue features of the Service at any time. We are not required to maintain any particular feature indefinitely.

2. Eligibility & Your Account

You must be legally permitted to use the Service under laws applicable to you. If you are under the legal age required to use online services in your jurisdiction, you may use Imagica only with the permission and supervision of a parent or legal guardian.

Account Responsibilities: Some features require creating an account. You are responsible for providing accurate information, maintaining credentials securely, and all activity occurring under your account.

Prohibited Account Activity: You must not impersonate others, use another person's account without authorization, create accounts to circumvent usage restrictions, create multiple accounts to abuse free allowances, or attempt unauthorized access to another user's information.

Suspension & Termination: We may suspend or terminate accounts that violate these Terms, create security or legal risks, engage in fraudulent activity, or abuse the Service.

3. User Content & Uploaded Images

You may upload images, text, prompts, instructions, and other materials to Imagica (“User Content”). You retain ownership of your original User Content. Imagica does not claim ownership of your original uploaded images merely because you process them through the Service.

Operational License: By submitting User Content, you grant Imagica the limited rights necessary to process, transmit, store, and transform that content solely to deliver the features you request (including sending relevant data to necessary third-party AI or infrastructure providers).

Your Responsibility: You represent and warrant that you own or have obtained all necessary rights and permissions to upload and process your content. You must not upload content that infringes upon copyright, trademark, privacy, publicity, or contractual rights of any third party.

4. AI-Generated Content & Intellectual Property

Ownership of Outputs: To the extent permitted by applicable law, Imagica does not claim ownership of images generated specifically for you through the Service. You are responsible for determining whether you have sufficient legal rights to use generated content for your intended purposes.

Nature of AI Results: AI-generated outputs may sometimes be inaccurate, unexpected, distorted, or contain artifacts. You acknowledge that outputs may vary between requests, are not guaranteed to be unique across different users submitting similar prompts, and that you are responsible for reviewing generated media before using or publishing it.

Imagica IP: The Imagica name, logo, branding, web interface, software code, and documentation remain the exclusive intellectual property of Imagica Inc. You may not copy, reverse engineer, or create derivative works of Imagica's proprietary software.

5. Acceptable Use Policy

You agree to use Imagica only for lawful purposes. You strictly must not use the Service to:

• Create or distribute Child Sexual Abuse Material (CSAM) or any form of child exploitation;
• Generate non-consensual intimate imagery or deceptive deepfakes intended to defraud or harass;
• Violate applicable laws, regulations, or third-party intellectual property and privacy rights;
• Create or distribute malware, malicious code, or automated exploit scripts;
• Attempt to compromise security, bypass authentication, manipulate rate limits, or exploit bugs;
• Abuse free usage tiers or place unreasonable computational loads on the Service; or
• Interfere with the operation of Imagica or attempt to access other users' data.

6. Third-Party Services & Infrastructure

Imagica may utilize third-party technology providers for cloud computing, GPU inference, storage, authentication, email delivery, security, and analytics. Availability and performance of certain features may depend on these providers, who operate under their own applicable terms and privacy policies.

Security Reporting: Security vulnerabilities in Imagica may be responsibly reported to: security@imagica.co.in.

7. Disclaimer of Warranties & Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMAGICA IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGICA AND ITS OPERATORS, AFFILIATES, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Governing Law: These Terms are governed by applicable statutory laws, subject to any mandatory rights available to you under applicable consumer protection law.

Amendments: We may update these Terms from time to time. When material changes occur, we will provide notice through the Service. Continued use after changes take effect constitutes acceptance.
